| 随着互联网和大数据等现代信息技术的飞速发展，图书馆在资源馆藏及文献服务方面实现数字化转型是必然趋势。基于对司法判例的研究，梳理镜像服务给图书馆和数据库商带来的法律风险，并对法律风险涉及问题，从其成因、性质及司法判决的合理性等多角度进行分析，分别从完善相关立法、发挥司法体系的指引作用、图书馆加强自身管理、数据库商及出版机构从根源上完善授权等方面提出应对方案，以期为有效应对镜像服务法律风险提供指引。 |

| With the rapid development of modern information technology such as the Internet and big data, it is an inevitable trend for libraries to realize the development of digital transformation in resource collection and document service。This paper summarizes and sorts out the legal risks brought by mirroring service to libraries and database providers through judicial decision, and analyzes the problems involved in the legal risks from multiple perspectives such as its causes, nature, and the rationality of judicial judgments. It puts forward the countermeasures of mirroring service legal risks from several aspects: improving relevant legislation, giving full play to the guiding role of the judicial system, strengthening library management, and perfecting authorization of database providers and publishing institutions from the root. It aims to provide guidance for libraries and database providers to effectively avoid the legal risks of mirroring service. |
